Terms of Service

By accessing or using NowBuild (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years of age and have the legal authority to enter into these Terms.

NowBuild is an AI-assisted product-marketing service for solo founders and small teams. The Service may analyze product information, prepare market research and campaign plans, generate and revise content, recommend channels and directories, assist with browser form filling, track user-reported or publicly available activity, and produce campaign reviews.

NowBuild is a software tool, not an employee, advertising agency, legal adviser, or managed marketing service. You remain responsible for business decisions and for reviewing and approving any output before use. We may modify, suspend, or discontinue features as the Service evolves.

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration • Maintain the security of your password and account • Promptly update your account information if it changes • Accept responsibility for all activities that occur under your account • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, misleading, or incomplete.

Certain features require payment. By subscribing, you agree to pay the displayed fees, provide valid payment information, and authorize recurring charges for the selected billing cycle.

Monthly subscription: The Agent Launch Team is billed monthly unless a different offer is expressly presented to you. A subscription renews automatically until canceled.

Cancellation: You may cancel at any time. Cancellation takes effect at the end of the current billing period, and access remains available until then. Except where required by law, fees are non-refundable and no partial-period refunds are provided.

Price changes: We may change prices for future billing periods. We will provide advance notice of material changes as required by applicable law.

Unless your order or an in-product offer states otherwise, each paid subscription includes:

• One active product • One active 30-day Campaign at a time • The channels currently supported by the Service and selected as relevant to that Campaign • One new 30-day Campaign per billing cycle • Access to the current curated directory database and automated submission to 76 supported directories

AI content generation, revisions, research, tool calls, and retries are subject to reasonable-use limits designed to prevent abuse and keep the Service reliable. We may slow, limit, or temporarily pause unusually intensive, automated, shared, or abusive usage. We will not use a reasonable-use limit to reduce the ordinary operation of a single Campaign without notice.

An additional product or Campaign may require a separate purchase. Directory counts describe available opportunities and supported submission flows, not a promise that every directory is relevant, free, reachable, eligible, or approved.

You agree not to use the Service to:

• Violate any applicable laws or regulations • Infringe on the intellectual property rights of others • Distribute malware, spam, or harmful content • Attempt to gain unauthorized access to the Service or other users' accounts • Interfere with or disrupt the Service or its infrastructure • Use the Service for any illegal or unauthorized purpose • Engage in any activity that could harm the Service or its users

The Service and its original content, features, and functionality are owned by NowBuild and are protected by international copyright, trademark, and other intellectual property laws.

Your content remains yours. By uploading content to the Service, you grant us a non-exclusive, worldwide license to use, store, and display that content solely for the purpose of providing the Service.

You may not copy, modify, distribute, sell, or lease any part of our Service without explicit written permission.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOWBUILD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

THE SERVICE AND ALL AI-GENERATED OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. AI output may be incomplete, inaccurate, outdated, or unsuitable for a particular platform. You must review output and ensure that your use complies with applicable laws, intellectual-property rights, advertising rules, and platform policies.

NowBuild prepares research, plans, content, and submission information and may automate submission to supported directories after your authorization. Account access, CAPTCHAs, payments, and any platform-required confirmation remain your responsibility. We do not store third-party platform passwords and will not operate an external account without the authorization required by that platform.

We do not guarantee directory eligibility or approval, backlinks, publication timing, search rankings, traffic, engagement, leads, revenue, product-market fit, or any other growth outcome. Third-party platforms may change their rules, pricing, availability, or review decisions at any time.

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive, including ownership, warranty disclaimers, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which NowBuild is incorporated, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration authority.

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on this page and updating the "Last updated" date.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
